Daily Checkin is operated by DailyCheckin LLC ("Company," "we," "us"). These Terms of Use govern your use of the Daily Checkin iOS app and this website. By using Daily Checkin, you agree to these terms.
Eligibility
You must be at least 13 years old to use Daily Checkin. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
What Daily Checkin does
Daily Checkin sends you a daily notification asking how you feel, and — if you configure it — follow-up SMS text reminders and a voice call if you don't respond. If none of those get a response, we email the emergency contact you designated, letting them know you haven't checked in.
Not an emergency service
DAILY CHECKIN IS NOT A MEDICAL ALERT SERVICE, EMERGENCY RESPONSE SERVICE, OR MONITORING SERVICE OF ANY KIND. It is a convenience tool that sends scheduled reminders and, if you don't respond, notifies a contact you designate. It does not detect, assess, or respond to medical emergencies, and no one monitors it in real time on your behalf. If you or someone else is experiencing a medical emergency, call 911 (or your local emergency number) immediately. Do not rely on Daily Checkin, or the absence of an emergency-contact notification, as an indication that you or anyone else is safe.
Subscriptions and billing
Daily Checkin offers a free trial followed by an auto-renewing subscription (monthly or annual), billed through your Apple App Store account. Payment is charged at the confirmation of purchase and at the start of each renewal period unless you cancel at least 24 hours before the current period ends. You can manage or cancel your subscription anytime in your Apple ID account settings — we don't process payments or handle refunds directly; those are governed by Apple's Media Services Terms and Conditions.
SMS, MMS, and voice call consent
By providing a mobile phone number to Daily Checkin, you expressly consent to receive recurring automated text messages (SMS/MMS) and automated or prerecorded voice calls from Daily Checkin at that number, for the purpose of daily wellness check-ins and related reminders. Message frequency varies based on your configured schedule (up to several messages or calls per day). Message and data rates may apply from your wireless carrier. Consent to receive these messages is not a condition of purchasing any product or service.
You may withdraw consent at any time by replying STOP to any message, removing your phone number in the app's settings, or cancelling your subscription; reply HELP for assistance. Carriers are not liable for delayed or undelivered messages. Daily Checkin is not responsible for messages or calls that are not received due to your device's settings, carrier network issues, insufficient signal, an incorrect or reassigned phone number, or any other circumstance outside our control.
No guarantee of delivery
Daily Checkin uses third-party telecommunications carriers, cloud infrastructure, and Apple's push notification and App Store systems to deliver reminders, calls, and emergency-contact emails. We do not control these third-party systems and cannot guarantee that any reminder, call, or email will be delivered, delivered on time, or delivered at all. You acknowledge that outages, delays, filtering, blocking, or failures of these third-party systems can prevent a message from reaching you or your emergency contact, and that Daily Checkin is not liable for any consequence of such a failure.
Disclaimer of warranties
DAILY CHECKIN IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY REMINDER, CALL, OR NOTIFICATION WILL BE DELIVERED OR ACTED UPON.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DAILY CHECKIN, DAILYCHECKIN LLC, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, OR EMOTIONAL DISTRESS, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE — INCLUDING ANY FAILURE, DELAY, OR ERROR IN SENDING OR DELIVERING A REMINDER, TEXT MESSAGE, VOICE CALL, OR EMERGENCY-CONTACT NOTIFICATION — REGARDLESS OF THE LEGAL THEORY ASSERTED (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) US $20.
Assumption of risk
You understand and agree that relying on an automated reminder and notification tool carries inherent risk — including the risk that a reminder is missed, a call goes unanswered, a message is delayed, or an emergency contact is not reached in time — and you assume that risk entirely. You are solely responsible for maintaining your own safety plan and for ensuring your emergency contact information is current.
Indemnification
You agree to indemnify and hold harmless Daily Checkin and DailyCheckin LLC from any claim, loss, or damage, including reasonable attorneys' fees, arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party (including your designated emergency contact or any person you notify through the Service).
Your responsibilities
You're responsible for keeping your phone number, reminder schedule, and emergency contact information accurate and up to date. Daily Checkin can only notify who you've told it to notify, using the contact details you've provided.
Emergency contact disclosure
If you don't respond to your check-in after the reminders you've configured, we send an email to your designated emergency contact stating only that you did not respond to a scheduled check-in, along with the time of the last attempt — no other personal information is shared.
Account and data
You sign in with your Apple ID. You may delete your account and associated data at any time by contacting us. See our Privacy Policy for details on what we collect and how it's used.
Changes to these terms
We may update these terms from time to time. Continued use of the app after a change constitutes acceptance of the updated terms.
